They also explain<\/span> the process the university will follow <span role=\"insertion\">in cases of sexual misconduct.<\/span> <span role=\"deletion\">where such matters are brought to its attention.<\/span>\r\n<h3><span role=\"insertion\">How to Notify the University of Sexual Misconduct: Three <span class=\"edit\">Options<\/span><\/span>[footnote]<strong>Comment [EDITOR18]:<\/strong> I have edited the heads to give more information; in this case, the reader now knows this section is \u201chow to do it\u201d rather than general information on disclosures, complaints, and reports[\/footnote]<\/h3>\r\n<span role=\"deletion\">If a person witnesses or experiences<\/span> <span role=\"insertion\">If <span class=\"edit\">you<\/span>[footnote]<strong>Comment [EDITOR19]:<\/strong> Plain language principle: wherever possible, write directly to the reader (use second person \u2013\u201cyou\u201d). <strong>Comment [EDITOR20]:<\/strong> Suggest putting \u201cexperienced\u201d before \u201cwitnessed\u201d so victims are addressed first.[\/footnote] have experienced or witnessed<\/span> sexual misconduct, <span role=\"deletion\">or there is reason to believe<\/span> <span role=\"insertion\">or you know <\/span> sexual misconduct has occurred or may occur, <span role=\"deletion\">the person may pursue one or more of the following options<\/span> <span role=\"insertion\">you have three options to notify the university<\/span>:\r\n<ol>\r\n \t<li><span role=\"insertion\">Making a <span class=\"edit\">disclosure<\/span><\/span>[footnote]<strong>Comment [EDITOR21]:<\/strong> Plain language principle: Use lists for readability and clarity[\/footnote]<\/li>\r\n \t<li><span role=\"insertion\">Making a formal complaint<\/span><\/li>\r\n \t<li><span role=\"insertion\">Reporting to the police<\/span><\/li>\r\n<\/ol>\r\n<span role=\"insertion\">You can choose one, two, or all three of these options. <\/span><span class=\"edit\"><span role=\"insertion\">For example, you may decide you want to make a disclosure, and then later elevate the notification to a formal complaint.<\/span><\/span>[footnote]<strong>Comment [EDITOR22]:<\/strong> Examples help to clarify instructions.[\/footnote]\r\n\r\n<span role=\"insertion\">The university recognizes that individuals who have experienced sexual misconduct may wish to maintain control over whether and how the university will deal with their experience. The choice you make on how to notify the university will affect your level of <span class=\"edit\">control.<\/span><\/span>[footnote]<strong>Comment [EDITOR23]:<\/strong> I have moved this up from the original section on maintaining control and rearranged the information from that section throughout to make it clear in each choice provided[\/footnote]\r\n<ol type=\"a\">\r\n \t<li><strong><span role=\"insertion\">Making a<\/span> Disclosure.<\/strong>\r\n<ol type=\"i\">\r\n \t<li>A disclosure is an informal notification to the university that sexual misconduct has occurred or that <span role=\"deletion\">a person has<\/span> <span role=\"insertion\">there is<\/span> reason to believe it may<span class=\"edit\"> occur.<\/span>[footnote]<strong>Comment [EDITOR24]:<\/strong> I\u2019ve reordered these steps (and split one into two) so they more logically answer the questions that are most likely at the forefront of the reader\u2019s mind: 1) What is a disclosure? 2) How do I make a disclosure? 3) How will I be helped? 4) What does the university do (or, in this case, not do)?[\/footnote]<\/li>\r\n \t<li><span role=\"deletion\">A person making<\/span> <span role=\"insertion\">You can make<\/span> a disclosure <span role=\"deletion\">may make the Disclosure<\/span> to any employee of the university or support person on campus (e.g., counsellor, nurse practitioner, doctor, manager, <span role=\"deletion\">Regional Principal,<\/span> residence advisor, security, <span role=\"deletion\">or<\/span> students\u2019 union).<\/li>\r\n \t<li><span role=\"deletion\">A person who makes a Disclosure that they have experienced Sexual Misconduct<\/span> <span role=\"insertion\">By making a disclosure that you have experienced sexual misconduct, you<\/span> may obtain supports (e.g., medical assistance, counselling) and where appropriate, reasonable academic accommodations <span role=\"deletion\">without making a Complaint or Report<\/span>.<\/li>\r\n \t<li><span role=\"insertion\">The university will not formally investigate a disclosure unless the university believes there is an imminent risk of harm to someone or there is a legal requirement to do so. That means you will not have access to certain remedies and no one will be disciplined for what happened. If you want the university to investigate the sexual misconduct, you need to make formal complaint or a report to the police (see below).<\/span><span role=\"deletion\">will not be treated as a Complaint and will not be formally investigated by the university unless the university believes there is an imminent risk of harm to a person or there is a legal requirement for the university to do so.<\/span><\/li>\r\n<\/ol>\r\n<\/li>\r\n \t<li><strong><span role=\"insertion\">Making a<\/span> Complaint<\/strong>\r\n<ol type=\"i\">\r\n \t<li>A complaint is a formal notification to the university of sexual misconduct, made by the person who experiences the sexual misconduct.<\/li>\r\n \t<li><span role=\"deletion\">A person who is<\/span> <span role=\"insertion\">If you are<\/span> considering filing a complaint, you may consult <span role=\"deletion\">with<\/span> a counsellor or wellness coach who can answer questions and <span role=\"deletion\">assist the individual with the Complaint process.<\/span> <span role=\"insertion\">help you with the process<\/span>.<\/li>\r\n \t<li><span role=\"insertion\">It is helpful to file a complaint as soon as possible after the incident of sexual misconduct. A delay in filing a complaint could affect the investigation and the outcome. However, the university recognizes that individuals who have experienced sexual misconduct may need some time before they are prepared to file a complaint.<\/span><\/li>\r\n \t<li><span role=\"insertion\">Your complaint must be submitted in writing to the Student Services Director. It must contain sufficient information of the allegations of sexual misconduct to allow the university to conduct an investigation. This includes:<\/span>\r\n<ol type=\"a\">\r\n \t<li><span role=\"insertion\">the date, time, and location of the alleged sexual misconduct;<\/span><\/li>\r\n \t<li><span role=\"insertion\">the names, and if available, contact information, of any individuals involved; and<\/span><\/li>\r\n \t<li><span role=\"insertion\">the names, and if available, contact information, of any witnesses.<\/span><\/li>\r\n<\/ol>\r\n<\/li>\r\n \t<li><span role=\"deletion\">Upon receipt of a complaint, the university<\/span> <span role=\"insertion\">When the university receives the complaint, it<\/span> will <span role=\"deletion\">initiate<\/span> <span role=\"insertion\">begin<\/span> a formal investigation. <span role=\"insertion\">If the complaint is substantiated, you will have access to remedies that are not available through a disclosure. In this process, the university will consider your wishes as far as possible.<\/span> <span role=\"deletion\">as provided for in these Procedures.<\/span><\/li>\r\n \t<li><span role=\"deletion\">The person who files the Complaint may<\/span> <span role=\"insertion\">You may<\/span> withdraw the complaint at any time. <span role=\"insertion\">Note, however, if you withdraw a complaint, the university may still proceed with an investigation.<\/span> <span role=\"deletion\">However, the withdrawal of a Complaint does not guarantee that the Complaint will not be investigated or that there will be no consequences to any individuals flowing from the <span class=\"edit\">Complaint<\/span>.<\/span>[footnote]<strong>Comment [EDITOR25]:<\/strong> This item edited to correct the overuse of negatives and simplify the statement.[\/footnote]<\/li>\r\n<\/ol>\r\n<\/li>\r\n \t<li><strong><span role=\"insertion\">Making a<\/span> Report<\/strong>\r\n<ol type=\"i\">\r\n \t<li>A report is <span role=\"insertion\">a<\/span> notification to the RCMP <span role=\"deletion\">of<\/span> <span role=\"insertion\">that<\/span> sexual misconduct <span role=\"deletion\">that<\/span> has occurred that a person <span role=\"deletion\">reasonably<\/span> believes <span role=\"deletion\">rises to the level of criminal conduct.<\/span> <span role=\"insertion\">is a crime.<\/span>[footnote]<strong>Comment [EDITOR26]:<\/strong> Edited to be more direct and succinct. I also think you need to be cautious of wording that the misconduct might \u201crise to the level...\u201d which could be read as judging the severity of how the misconduct impacted the survivor\/person. I do understand the legal nuance, and that to be a crime, several tests must be met \u2013but the point here is that a person may report the incident to the police \u2013and the police will then determine if a crime has been committed. [\/footnote]<\/li>\r\n \t<li><span role=\"deletion\">Individuals<\/span> <span role=\"insertion\">The university strongly encourages anyone<\/span> who experiences or witnessess sexual misconduct <span role=\"deletion\">that rises to the level of criminal conduct are strongly encouraged<\/span> <span role=\"insertion\">that they believe is a crime<\/span> to file a report.<\/li>\r\n \t<li><span role=\"deletion\">If a person advises<\/span> <span role=\"insertion\">If you advise<\/span> the university that <span role=\"deletion\">they<\/span> <span role=\"insertion\">you<\/span> intend to make a report, <span role=\"deletion\">the university will make available to them a support person on campus who can support them in making the report<\/span> <span role=\"insertion\">a support person on campus can help you with it.<\/span><\/li>\r\n \t<li>The university <span role=\"insertion\">will cooperate with any criminal investigation arising from a report<\/span>, to the extent it is reasonable to do so and is permitted by law<span role=\"deletion\">, will cooperate with any criminal investigation arising from a Report<\/span>.<\/li>\r\n \t<li>The university may be required to initiate an investigation and\/or report of alleged sexual misconduct to the RCMP, <span role=\"deletion\">even without the consent of the individual who has experienced the sexual misconduct<\/span> <span role=\"insertion\">even without your consent<\/span> in certain cases:\r\n<ol type=\"a\">\r\n \t<li>if the allegation involves sexual misconduct involving a minor;<\/li>\r\n \t<li>if the <span role=\"deletion\">applicable legislation<\/span> <span role=\"insertion\">law<\/span> requires the university <span role=\"deletion\">to carry out an investigation<\/span> <span role=\"insertion\">to investigate<\/span>; or<\/li>\r\n \t<li>if the university <span role=\"deletion\">has a reasonable belief that there exists<\/span> <span role=\"insertion\">believes there is<\/span> a risk to the health or safety of a member of the university community.<\/li>\r\n<\/ol>\r\n<\/li>\r\n<\/ol>\r\n<\/li>\r\n<\/ol>\r\n<span role=\"deletion\">Should the<\/span> <span role=\"insertion\">If the<\/span> university initiates an investigation or informs the RCMP about alleged sexual misconduct without <span role=\"deletion\">the consent of the individual<\/span> <span role=\"insertion\">your consent<\/span>, the university will notify <span role=\"deletion\">that individual<\/span> <span role=\"insertion\">you<\/span> that it has done so.\r\n<h3><span role=\"deletion\">Control over <\/span><span class=\"edit\"><span role=\"deletion\">Process<\/span><\/span>[footnote]<strong>Comment [EDITOR27]:<\/strong> This section was problematic structurally. I have incorporated the information into other sections of the document.[\/footnote]<\/h3>\r\n<span role=\"deletion\">The university recognizes that individuals who have experienced Sexual Misconduct may wish to maintain control over whether and how their experience will be dealt with by the university. Which of the above option(s) the individual elects to pursue will impact on the level of that control.<\/span>\r\n<h3><span role=\"deletion\">Responding to<\/span> <span role=\"insertion\">How the University Responds to<\/span> <span class=\"edit\">Disclosures<\/span>[footnote]<strong>Comment [EDITOR28]:<\/strong> I have edited this section to keep the point of view to the reader \u2013the victim \u2013rather than to the person receiving the disclosure[\/footnote]<\/h3>\r\n<span role=\"deletion\">Where an individual<\/span> <span role=\"insertion\">When you<\/span> make a disclosure <span role=\"insertion\">of sexual misconduct<\/span> to an employee of the university or support person on campus <span role=\"deletion\">that they have experienced Sexual Misconduct<\/span>, <span role=\"insertion\">you can expect<\/span> the employee or support person <span role=\"deletion\">should<\/span> to:\r\n<ol>\r\n \t<li>listen without judgment;<\/li>\r\n \t<li>communicate that sexual misconduct is not <span role=\"deletion\">the fault of the person who has experienced it<\/span> <span role=\"insertion\">your fault<\/span>;<\/li>\r\n \t<li>help <span role=\"deletion\">the individual to<\/span> <span role=\"insertion\">you<\/span> identify and\/or access available <span role=\"deletion\">on or off campus services<\/span> <span role=\"insertion\">services, on or off campus,<\/span> such as emergency medical care or counselling;<\/li>\r\n \t<li><span role=\"deletion\">respect the individual\u2019s<\/span> <span role=\"insertion\">respect your<\/span> right to choose the services <span role=\"deletion\">they<\/span> <span role=\"insertion\">you<\/span> feel are most appropriate, <span role=\"deletion\">for them and the individual's right<\/span> <span role=\"insertion\"> and to decide whether to make a complaint or a report;<\/span><\/li>\r\n \t<li>recognize that disclosing sexual misconduct can be traumatic, and that <span role=\"deletion\">an individual\u2019s ability<\/span> <span role=\"insertion\">your ability<\/span> to recall the events may be limited or otherwise impacted;<\/li>\r\n \t<li>respect <span role=\"deletion\">the individual\u2019s choice<\/span> <span role=\"insertion\">your choice<\/span> about how much <span role=\"deletion\">they<\/span> <span role=\"insertion\">you<\/span> disclose about <span role=\"deletion\">their<\/span> <span role=\"deletion\">your<\/span> experience; and<\/li>\r\n \t<li>make every effort to respect <span role=\"insertion\">your<\/span> confidentiality and anonymity.<\/li>\r\n<\/ol>\r\n<span role=\"deletion\">Employees of the University to whom a Disclosure is made<\/span> <span role=\"insertion\">University employees who receive a disclosure<\/span> or who otherwise become aware of sexual misconduct are required to notify the Student Services Director <span role=\"deletion\">(the \u201cDirector\u201d)<\/span> <span role=\"deletion\">and, where appropriate<\/span> <span role=\"insertion\">or<\/span> university security. <span role=\"deletion\">The identities of the individuals involved in the Sexual Misconduct should only be disclosed where reasonably required for University purposes and\/or for the purposes of protecting the health and safety of any individual.<\/span> <span role=\"insertion\">They will not disclose your identity (or the identity of anyone else involved) unless required for university purposes to protect the health and safety of any individual.<\/span>\r\n\r\nThe Director and\/or university security who receives the information will assess it and determine whether<span role=\"deletion\">, based on that information,<\/span> there is a risk to <span role=\"deletion\">the health or safety of anyone<\/span> <span role=\"insertion\">anyone's health and safety<\/span>. If so, <span role=\"deletion\">the Director and\/or university security<\/span> <span role=\"insertion\">they<\/span> will take steps to protect <span role=\"deletion\">the health and safety of<\/span> those at risk. If not, <span role=\"deletion\">and unless otherwise required by law,<\/span> the university will not formally investigate a disclosure <span role=\"insertion\">unless required by law<\/span>.\r\n\r\n<span role=\"deletion\">Should a student, in making a Disclosure, request<\/span> <span role=\"insertion\">If you ask for<\/span> support or academic accommodation <span role=\"insertion\">when you make a disclosure,<\/span> <span role=\"deletion\">the student and the Director will meet to discuss the request.<\/span> <span role=\"insertion\">the Director will meet with you to discuss your request and work with you and any instructors, as needed, to meet your needs. The Director will keep the information confidential as far as possible.<\/span> <span role=\"deletion\">Where there is a reasonable basis for the request, the Director will work together with the student and any instructors as appropriate, to ensure that the student receives all necessary reasonable support and\/or academic accommodations, while maintaining confidentiality, to the extent that it is reasonably possible to do so.<\/span>\r\n<h3><span role=\"deletion\">Responding to<\/span> <span role=\"insertion\">How the University Responds<\/span> to Complaints<\/h3>\r\n<h4>Ensuring Health and Safety<\/h4>\r\nWhen the Director receives a complaint, their first priority <span role=\"deletion\">will be<\/span> <span role=\"insertion\">is<\/span> to ensure the health and safety of those involved and of all members of the university community. <span role=\"deletion\">In order to do so<\/span> <span role=\"insertion\">To do this,<\/span> the Director may:\r\n<ol>\r\n \t<li>meet with <span role=\"deletion\">whomever they deem <\/span> <span role=\"insertion\">anyone<\/span> necessary to determine whether there is a threat to the health or safety of any member of the university;<\/li>\r\n \t<li>take <span role=\"deletion\">action the Director deems appropriate<\/span> <span role=\"insertion\">appropriate action<\/span> to ensure the health and safety of any member of the university community; and<\/li>\r\n \t<li>contact the RCMP.<\/li>\r\n<\/ol>\r\n<span role=\"deletion\">In doing so,<\/span> The Director will maintain the confidentiality of individuals involved <span role=\"deletion\">to the extent that it is reasonably possible to do so<\/span> <span role=\"insertion\">as far as possible<\/span>.\r\n<h4><span role=\"deletion\">Initial Complaint Review<\/span><span role=\"insertion\">Reviewing the Complaint<\/span><\/h4>\r\n<h5><span role=\"insertion\">A complaint against a <\/span><span class=\"edit\"><span role=\"insertion\">student<\/span><\/span>[footnote]<strong>Comment [EDITOR29]:<\/strong> I have added sub-heads to this section to help orient the reader to the next steps[\/footnote]<\/h5>\r\n<span role=\"insertion\">If you make a formal complaint against another student, the Director will take the following steps:<\/span>\r\n<ol>\r\n \t<li><span role=\"deletion\">The Director will<\/span> Review the complaint to ensure it contains <span role=\"deletion\">sufficient detail necessary for the University to<\/span> <span role=\"insertion\">enough detail to carry out an investigation.<\/span><\/li>\r\n \t<li><span role=\"deletion\">If there is not enough detail in the complaint, the Director will<\/span> Contact you and give you the opportunity to provide further details, <span role=\"insertion\">if needed<\/span>.<\/li>\r\n \t<li><span role=\"deletion\">If the Director determines that a complaint has enough detail, they will<\/span> Initiate an investigation <span role=\"insertion\">if there is enough detail<\/span>.<\/li>\r\n \t<li><span role=\"deletion\">When the Director receives a Complaint, prior to commencing an investigation, the Director will review the Complaint and ensure that it contains sufficient detail necessary for the university to carry out an investigation.<\/span><\/li>\r\n<\/ol>\r\n<span role=\"deletion\">Where the Director determines there is insufficient detail in the Complaint,the Director will contact the individual who filed the Complaint, advise them of the deficiencies, and allow them the opportunity to provide further details in a timely manner.<\/span>\r\n\r\n<span role=\"deletion\">Where the Director determines that a Complaint has sufficient detail necessary for the university to carry out an investigation, the Director will initiate the investigation process.<\/span>\r\n\r\n<span role=\"deletion\">At any point prior to<\/span> <span role=\"insertion\">At any time before<\/span> or during an investigation, the university may take interim measures to address any concerns <span role=\"deletion\">it may have<\/span> about the well-being of any member of the university <span role=\"insertion\">pending the investigation<\/span>, while minimizing the impact on other individuals involved and <span role=\"deletion\">recognizing the principle of the presumption of innocence.<\/span> <span role=\"insertion\">upholding the principle that a person is <span class=\"edit\">presumed innocent<\/span>[footnote]<strong>Comment [EDITOR30]:<\/strong> Simplify words and phrases where possible.[\/footnote] until found guilty.<\/span>\r\n<h5><span role=\"deletion\">When an Employee is Party to Complaint<\/span><span role=\"insertion\">A complaint against an <\/span><span class=\"edit\"><span role=\"insertion\">employee<\/span><\/span>[footnote]<strong>Comment [EDITOR31]:<\/strong> I\u2019ve restructured and heavily edited this section. The original topic sentence referenced a student respondent, underneath the heading referring to employees, and the legalese language will be challenging to most readers[\/footnote]<\/h5>\r\n<span role=\"insertion\">If you make a formal complaint against an employee, the university will investigate in one of the following <span class=\"edit\">ways:<\/span><\/span>[footnote]<strong>Comment [EDITOR32]:<\/strong> \u201cParty to a complaint\u201d (used in the original) is not helpful language. Besides being legalese, it is not clear, because both the person making the complaint and the person accused are a \u201cparty.\u201d[\/footnote]\r\n<ol>\r\n \t<li><span role=\"deletion\">Where a party to a Complaint<\/span> <span role=\"insertion\">If the person you accuse of sexual misconduct<\/span> is a union employee <span role=\"deletion\">whose employment is governed by a collective agreement<\/span>, <span role=\"insertion\">the university will investigate following the procedures of the collective agreement.<\/span><\/li>\r\n \t<li><span role=\"deletion\">Where a party to a Complaint is an employee who is not subject to a collective agreement that requires the University to investigate such Complaints in accordance with procedures provided therein, the University will investigate the Complaint in accordance with the procedures provided for in the University\u2019s Respectful Workplace Policy. In such circumstances, at the commencement of the investigation, the University will provide the student involved in the Complaint with a copy of those procedures.<\/span> <span role=\"insertion\">If the person you accuse of sexual misconduct is a <span class=\"edit\">non-union employee,<\/span>[footnote]<strong>Comment [EDITOR33]:<\/strong> Changed to simply \u201cnon-union\u201d for fewer words and clarity[\/footnote] the university will investigate following the procedures in the university\u2019s Respectful Workplace Policy.<\/span><\/li>\r\n<\/ol>\r\n<span role=\"insertion\">In both these cases, the university will provide you with a copy of the relevant procedures at the start of the investigation.<\/span>\r\n<h4><span role=\"deletion\">Investigation<\/span><span role=\"insertion\">Investigating the Complaint<\/span><\/h4>\r\n<span role=\"deletion\">Where<\/span> <span role=\"insertion\">When<\/span> the Director determines an investigation <span role=\"deletion\">is to proceed under these Procedures, the Director will assess the Complaint and, depending on their assessment of the Complaint, their relevant knowledge and expertise, and any other factors they deem appropriate, will:<\/span> <span role=\"insertion\">should proceed, they will decide the next steps depending on their assessment of the complaint. The choice you make on how to notify the university will affect your level of <span class=\"edit\">control.<\/span><\/span><a class=\"footnote\" title=\"Comment [EDITOR23]: I have moved this up from the original section on maintaining control and rearranged the information from that section throughout to make it clear in each choice provided\" id=\"return-footnote-30-5\" href=\"#footnote-30-5\" aria-label=\"Footnote 5\"><sup class=\"footnote\">[5]<\/sup><\/a><\/p>\n<ol type=\"a\">\n<li><strong><span role=\"insertion\">Making a<\/span> Disclosure.<\/strong>\n<ol type=\"i\">\n<li>A disclosure is an informal notification to the university that sexual misconduct has occurred or that <span role=\"deletion\">a person has<\/span> <span role=\"insertion\">there is<\/span> reason to believe it may<span class=\"edit\"> occur.<\/span><a class=\"footnote\" title=\"Comment [EDITOR24]: I\u2019ve reordered these steps (and split one into two) so they more logically answer the questions that are most likely at the forefront of the reader\u2019s mind: 1) What is a disclosure? 2) How do I make a disclosure? 3) How will I be helped? 4) What does the university do (or, in this case, not do)?\" id=\"return-footnote-30-6\" href=\"#footnote-30-6\" aria-label=\"Footnote 6\"><sup class=\"footnote\">[6]<\/sup><\/a><\/li>\n<li><span role=\"deletion\">A person making<\/span> <span role=\"insertion\">You can make<\/span> a disclosure <span role=\"deletion\">may make the Disclosure<\/span> to any employee of the university or support person on campus (e.g., counsellor, nurse practitioner, doctor, manager, <span role=\"deletion\">Regional Principal,<\/span> residence advisor, security, <span role=\"deletion\">or<\/span> students\u2019 union).<\/li>\n<li><span role=\"deletion\">A person who makes a Disclosure that they have experienced Sexual Misconduct<\/span> <span role=\"insertion\">By making a disclosure that you have experienced sexual misconduct, you<\/span> may obtain supports (e.g., medical assistance, counselling) and where appropriate, reasonable academic accommodations <span role=\"deletion\">without making a Complaint or Report<\/span>.<\/li>\n<li><span role=\"insertion\">The university will not formally investigate a disclosure unless the university believes there is an imminent risk of harm to someone or there is a legal requirement to do so. That means you will not have access to certain remedies and no one will be disciplined for what happened. If you want the university to investigate the sexual misconduct, you need to make formal complaint or a report to the police (see below).<\/span><span role=\"deletion\">will not be treated as a Complaint and will not be formally investigated by the university unless the university believes there is an imminent risk of harm to a person or there is a legal requirement for the university to do so.<\/span><\/li>\n<\/ol>\n<\/li>\n<li><strong><span role=\"insertion\">Making a<\/span> Complaint<\/strong>\n<ol type=\"i\">\n<li>A complaint is a formal notification to the university of sexual misconduct, made by the person who experiences the sexual misconduct.<\/li>\n<li><span role=\"deletion\">A person who is<\/span> <span role=\"insertion\">If you are<\/span> considering filing a complaint, you may consult <span role=\"deletion\">with<\/span> a counsellor or wellness coach who can answer questions and <span role=\"deletion\">assist the individual with the Complaint process.<\/span> <span role=\"insertion\">help you with the process<\/span>.<\/li>\n<li><span role=\"insertion\">It is helpful to file a complaint as soon as possible after the incident of sexual misconduct. A delay in filing a complaint could affect the investigation and the outcome. However, the university recognizes that individuals who have experienced sexual misconduct may need some time before they are prepared to file a complaint.<\/span><\/li>\n<li><span role=\"insertion\">Your complaint must be submitted in writing to the Student Services Director. It must contain sufficient information of the allegations of sexual misconduct to allow the university to conduct an investigation. This includes:<\/span>\n<ol type=\"a\">\n<li><span role=\"insertion\">the date, time, and location of the alleged sexual misconduct;<\/span><\/li>\n<li><span role=\"insertion\">the names, and if available, contact information, of any individuals involved; and<\/span><\/li>\n<li><span role=\"insertion\">the names, and if available, contact information, of any witnesses.<\/span><\/li>\n<\/ol>\n<\/li>\n<li><span role=\"deletion\">Upon receipt of a complaint, the university<\/span> <span role=\"insertion\">When the university receives the complaint, it<\/span> will <span role=\"deletion\">initiate<\/span> <span role=\"insertion\">begin<\/span> a formal investigation. <span role=\"insertion\">If the complaint is substantiated, you will have access to remedies that are not available through a disclosure. In this process, the university will consider your wishes as far as possible.<\/span> <span role=\"deletion\">as provided for in these Procedures.<\/span><\/li>\n<li><span role=\"deletion\">The person who files the Complaint may<\/span> <span role=\"insertion\">You may<\/span> withdraw the complaint at any time. <span role=\"insertion\">Note, however, if you withdraw a complaint, the university may still proceed with an investigation.<\/span> <span role=\"deletion\">However, the withdrawal of a Complaint does not guarantee that the Complaint will not be investigated or that there will be no consequences to any individuals flowing from the <span class=\"edit\">Complaint<\/span>.<\/span><a class=\"footnote\" title=\"Comment [EDITOR25]: This item edited to correct the overuse of negatives and simplify the statement.\" id=\"return-footnote-30-7\" href=\"#footnote-30-7\" aria-label=\"Footnote 7\"><sup class=\"footnote\">[7]<\/sup><\/a><\/li>\n<\/ol>\n<\/li>\n<li><strong><span role=\"insertion\">Making a<\/span> Report<\/strong>\n<ol type=\"i\">\n<li>A report is <span role=\"insertion\">a<\/span> notification to the RCMP <span role=\"deletion\">of<\/span> <span role=\"insertion\">that<\/span> sexual misconduct <span role=\"deletion\">that<\/span> has occurred that a person <span role=\"deletion\">reasonably<\/span> believes <span role=\"deletion\">rises to the level of criminal conduct.<\/span> <span role=\"insertion\">is a crime.<\/span><a class=\"footnote\" title=\"Comment [EDITOR26]: Edited to be more direct and succinct. I do understand the legal nuance, and that to be a crime, several tests must be met \u2013but the point here is that a person may report the incident to the police \u2013and the police will then determine if a crime has been committed.\" id=\"return-footnote-30-8\" href=\"#footnote-30-8\" aria-label=\"Footnote 8\"><sup class=\"footnote\">[8]<\/sup><\/a><\/li>\n<li><span role=\"deletion\">Individuals<\/span> <span role=\"insertion\">The university strongly encourages anyone<\/span> who experiences or witnessess sexual misconduct <span role=\"deletion\">that rises to the level of criminal conduct are strongly encouraged<\/span> <span role=\"insertion\">that they believe is a crime<\/span> to file a report.<\/li>\n<li><span role=\"deletion\">If a person advises<\/span> <span role=\"insertion\">If you advise<\/span> the university that <span role=\"deletion\">they<\/span> <span role=\"insertion\">you<\/span> intend to make a report, <span role=\"deletion\">the university will make available to them a support person on campus who can support them in making the report<\/span> <span role=\"insertion\">a support person on campus can help you with it.<\/span><\/li>\n<li>The university <span role=\"insertion\">will cooperate with any criminal investigation arising from a report<\/span>, to the extent it is reasonable to do so and is permitted by law<span role=\"deletion\">, will cooperate with any criminal investigation arising from a Report<\/span>.<\/li>\n<li>The university may be required to initiate an investigation and\/or report of alleged sexual misconduct to the RCMP, <span role=\"deletion\">even without the consent of the individual who has experienced the sexual misconduct<\/span> <span role=\"insertion\">even without your consent<\/span> in certain cases:\n<ol type=\"a\">\n<li>if the allegation involves sexual misconduct involving a minor;<\/li>\n<li>if the <span role=\"deletion\">applicable legislation<\/span> <span role=\"insertion\">law<\/span> requires the university <span role=\"deletion\">to carry out an investigation<\/span> <span role=\"insertion\">to investigate<\/span>; or<\/li>\n<li>if the university <span role=\"deletion\">has a reasonable belief that there exists<\/span> <span role=\"insertion\">believes there is<\/span> a risk to the health or safety of a member of the university community.<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<p><span role=\"deletion\">Should the<\/span> <span role=\"insertion\">If the<\/span> university initiates an investigation or informs the RCMP about alleged sexual misconduct without <span role=\"deletion\">the consent of the individual<\/span> <span role=\"insertion\">your consent<\/span>, the university will notify <span role=\"deletion\">that individual<\/span> <span role=\"insertion\">you<\/span> that it has done so.<\/p>\n<h3><span role=\"deletion\">Control over <\/span><span class=\"edit\"><span role=\"deletion\">Process<\/span><\/span><a class=\"footnote\" title=\"Comment [EDITOR27]: This section was problematic structurally.
